Melissa C. Mihok

melissa_mihokMs. Melissa C. Mihok is a Partner in the Orlando office of CPLS, P.A. She is a member of the Firm’s Labor and Employment, Litigation, and Business Groups.

Ms. Mihok is Board Certified by the Florida Bar as a specialist in labor and employment, having practiced exclusively in labor and employment for more than 15 years. During this time, Ms. Mihok has worked at one of a handful of firms chosen by the Florida Education Association to represent its members statewide in disciplinary and certification matters, and managed her own former private practice where she focused on labor and employment. She holds an AV rating from Martindale-Hubbell, a rating achieved by only 5 percent of attorneys.

Ms. Mihok specializes in complex teacher disciplinary actions and certification issues, civil rights, and whistleblower reports, as well as handles difficult issues such as discrimination, retaliation, administrative hearings, union representation, mediations, arbitrations, and appeals.

Ms. Mihok has extensive experience representing many individuals in state and federal court in discrimination, retaliation, and whistleblower cases. She has represented clients in various areas of law, primarily focused on employee side labor and employment issues and administrative hearings. She has argued before the Court of Appeal as well as represented clients in mediations and arbitrations.

Ms. Mihok strives to provide the client with the best legal representation that can be provided, based upon the particular client’s needs and expectations. Depending on what the client is looking for, she provides them with tailored advice, counseling, and professional services.

Withers v. Blomberg
Second District Court of Appeals held that Education Practice Commission violated a teacher’s due process by failing to review the entire record.

Gabriele v. Manatee County School Board
Second District Court of Appeals held that the school board did not have the authority to revoke a teacher’s professional service contract and replace it with an annual contract.

Carter v. Health Management Associates
Second District Court of Appeals held that employee pled a cause of action for retaliation based upon reasonable good faith belief that she had been discriminated against because of her pregnancy.

Commissioner of Education v. Corriveau
Florida Division of Administrative Hearings held Commissioner did not meet its burden to impose sanctions against the teacher’s educator certificate.

Manatee County School Board v. Willis
Florida Division of Administrative Hearings held School Board did not establish just cause to terminate the teacher’s employment based upon inappropriate Facebook posts.

Manatee County School Board v. Davis
